Medical Record Review and Written Opinion — Rhode Island

Quick Answers — Record Review and Written Opinion

What is a chiropractic record review? A chiropractic record review is a comprehensive analysis of medical records, imaging studies, and clinical documentation by a qualified chiropractic physician — producing a written opinion on causation, injury characterization, standard of care, and/or impairment.

When do attorneys request record review? When evaluating a case before filing, assessing the strength of existing clinical documentation, identifying documentation gaps, obtaining a second opinion on causation, or preparing for deposition or trial.

What does a written opinion from a record review contain? A summary of the records reviewed, identification of key clinical findings, analysis of causation, opinion on the adequacy of the clinical documentation, and responses to specific questions posed by the requesting attorney.

Is record review available for both plaintiff and defense matters? Yes, subject to case-specific conflict review.

What Is Chiropractic Record Review?

Chiropractic record review is a formal analysis of a patient's medical records — treatment records, diagnostic imaging, IME reports, and other clinical documentation — by a qualified chiropractic physician who has not treated the patient. The reviewing physician produces a written opinion addressing the specific clinical-legal questions posed by the requesting attorney.

Record review serves multiple purposes in Rhode Island personal injury and workers' compensation litigation:

Case Evaluation Attorneys evaluating whether to accept a case benefit from an independent clinical assessment of the existing records — identifying whether the documented findings support the claimed injuries and whether documentation gaps exist that could be exploited by the defense.

Causation Analysis When causation is disputed, a written opinion from a qualified chiropractic expert analyzing the medical records and connecting — or failing to connect — the documented findings to the claimed accident mechanism provides the clinical foundation for the causation argument.

Documentation Gap Identification Experienced PI chiropractic review identifies what is missing from the clinical record — undocumented neurological findings, absent objective testing, missing causation analysis — and what additional evaluation or documentation would strengthen the case.

Defense Record Review Defense attorneys and insurance carriers requesting record review of plaintiff clinical documentation receive objective analysis of the documentation's strengths and weaknesses — identifying areas for deposition examination and potential defense expert opinion.

Standard of Care Review When the adequacy of clinical care or documentation is at issue, written opinion on the applicable standard of care for chiropractic management of motor vehicle accident injuries in Rhode Island.
